Getting married in Henderson County starts at the clerk's window in Athens

A Texas marriage license isn't tied to where you live or where you'll hold the ceremony. You can get one from any county clerk in the state, and plenty of couples just walk into the office on the Athens square. The Henderson County Clerk, Mary Margaret Wright, keeps that counter in Room 101 at 125 N. Prairieville Street, open weekdays 8 to 5. Both of you generally need to show up together with valid photo ID.

Then there's the 72-hour rule, which surprises a lot of couples: a Texas license doesn't take effect until 72 hours after it's issued, so a Friday application can't become a Saturday wedding. Active-duty military and a few other applicants are exempt from that wait. Once issued, the license is good for 90 days, which gives you a comfortable window to set a date.

If one of you can't make it to Athens in person, the clerk handles an absent-applicant affidavit, and there's a separate version for an applicant who's away on military duty. That paperwork lets one partner do the legwork at the courthouse while the other signs off elsewhere, so it's smart to ask about it early rather than the week of the ceremony.
